二、人民甲主張：乙道路主管機關（以下稱「乙機關」 ）於民國 113 年 6 月 1 日，在其住宅門口前之道路，違法劃設禁止臨時停車線（以下稱「系爭標線」），妨礙其日常生活進出，損害其權益，遂於民國 114 年 7 月 1 日 提起訴願。對甲之訴願，乙機關主張：系爭標線自劃設完成時起即已生效，乙機關並無對甲為送達或另以其他適當方式通知甲之必要，訴願期間應自劃設完成時之次日起算，因此，甲之訴願已因逾越訴願期間而不 合法。對此，訴願人甲則主張系爭標線，係乙機關於其出國期間所劃設， 其劃設後仍應對之為送達或以其他適當方式對其為通知，然本件乙機關均未為之，其訴願期間自應於民國 114 年 6 月 15 日其回國後知悉之次日起算，故其提起訴願並未逾越訴願期間。試問：上開訴願人甲、乙機關之主張，何者有理由？（25 分）
