一、甲為 A 縣警察局警察，某日在執行交通勤務時，發現鄰縣 B 縣境內 有行人乙在禁止通行之紅燈亮起後仍通行。甲將乙攔下，於製作違規 紀錄，請乙簽名後，將該違規案件送由 A 縣警察局裁處。A 縣警察 局遂依道路交通管理處罰條例第 78 條第 1 項第 1 款規定，以裁處書 處乙新臺幣 500 元罰鍰。住居所位於 B 縣之乙認為 A 縣警察局並無 管轄權，且裁處書未記明理由，原處分違法，應予撤銷。試問：乙之主張是否有理由？請附具理由說明之。（25 分） 相關法條 道路交通管理處罰條例第 7 條第 1 項： 「道路交通管理之稽查，違規紀錄，由交通勤務警察，或依法令執行交通稽查任務人員執行之。」第 8 條第 1 項： 「違反本條例之 行為，由下列機關處罰之：一、第十二條至第六十八條及第九十二條第七項、第八 項由公路主管機關處罰。二、第六十九條至第八十四條由警察機關處罰。」第 78 條 第 1 項第 1 款： 「行人在道路上有下列情形之一者，處新臺幣五百元罰鍰：一、不依 標誌、標線、號誌之指示或警察指揮。」

二、甲為 A 大學助理教授，於 114 學年度第 1 學期申請升等為副教授。 依 A 大學規章之規定，助理教授申請升等為副教授，須研究、教學、 服務三個項目成績皆達 70 分以上，始為通過。因甲教學、服務項目之成績在系教師評審委員會（下稱教評會）與院教評會審查階段皆超過 70 分，院遂將其升等案送校教評會審查，並由學校就甲之升等著作辦理外審程序。甲之升等著作經送三位校外學者專家審查之結果， 其成績分別為 72 分、78 分、80 分。惟校教評會最終審議甲之升等案時，卻以外審委員乙對甲之代表著作評價偏低，與其他外審委員意見不同，另學生丙對於甲之教學有負面評語之理由，而不通過甲之升等 案，並由學校作成處分通知甲。甲認為校教評會不應再針對其研究項目進行評分，且其無視絕大多數學生對其之正面評語，原處分違法。 試問：甲之主張是否有理由？請附具理由說明之。（25 分）
