一、憲法並無明文規定立法院調查權，然而，釋憲實務對此則持肯定態度。 依據憲法法庭 113 年度憲判字第 9 號判決， 「立法院為能有效行使上開 憲法所賦予之職權，本其固有之權能，自得享有一定之調查權，主動獲 取行使職權所需之相關資訊，俾能充分思辯，審慎決定，以善盡國家最 高民意機關之職責，發揮權力分立與制衡之機能，是立法院調查權乃立 法院行使其憲法職權所必要之輔助性權力」 。在此前提下，若立法院調查 權行使涉及人民時，要求其提出文件、資料或物件，則其受憲法保障之 各種重要基本權，諸如隱私權、資訊隱私權、營業秘密、秘密通訊自由、 職業自由或營業自由等造成干預。當立法者課予人民有配合立法院調查 權行使之法律義務時，相關法律規定應符合那些憲法要求，始與憲法無 違？請申論之。（25 分）

二、人民甲闖紅燈遭執行交通稽查勤務之警察乙與丙攔停稽查。過程中，甲與乙產生爭執，於執行公務中，甲當場對乙接續出言，「公僕執法手插腰， 警察是流氓」等語辱罵之，足以貶抑一般人對依法執行職務之警察之人格及社會評價，旋遭執行職務之乙與丙，以妨害公務之現行犯逮捕。經檢察官提起公訴，法院判決有罪。甲窮盡訴訟救濟管道，仍遭判決有罪，欲提起憲法訴訟。請依憲法實務見解，論述下述參考法條有無牴觸憲法之疑慮。（25 分）參考法條：刑法第 140 條規定： 「於公務員依法執行職務時，當場侮辱或對於其依法執行之職務公然侮辱者，處 1 年以下有期徒刑、拘役或 10 萬元以下罰金。」
